  • It Can Bring you Peace of Mind - You have a lot on your plate right now. You are about to change your life by getting married to a foreigner who is going to want and need your full attention in helping her adjust to her new life with you.  Why worry about paperwork at a time like this?
  • Your options are to use an Attorney or Do it Yourself - Contrary to popular belief the law does not permit the payment of a fee or other consideration to be given for the purpose of filing immigration and naturalization petitions and applications. The U.S. CIS tends to view such things as evidence of a fraudulent marriage and any finding that you have done so can cause major problems for you and your spouse up to and including the initiation of removal proceedings.  Therefore, you should never pay any marriage agency or other non-lawyer for their "assistance."  Similarly, in almost all U.S. states it is illegal for a non-lawyer to provide advice in immigration law (even to just tell you which form to use). Doing this, also might result in both the loss of your filing fee and the fee you paid the non-lawyer if the forms were incorrectly completed and rejected.
  • It MIGHT Save You Some Time & Hassle - No one can guarantee you that they can "speed up" the process or make things happen before their normal time.  Knowing what documents and forms can be filed simultaneously, having such documents completed correctly and sent to the proper location can avoid unnecessary delay. Additionally, by keeping abreast of the latest changes to the law it helps me ensure that you will be advised correctly.

The Process and What I Can Offer to You

If you have not yet given it attention, your first consideration is whether to marry in her country, thus having her enter the U.S. under a Spousal Visa procedures, or to obtain a K-1 Fiancee Visa for her and marry when she arrives.

There are important pros and cons to either choice.  You and your fiancee should discuss the social, financial and personal aspects; and I am more than happy to discuss with you the legal procedures and ramifications of either choice free-of-charge.

In the ideal situation, divorce will never be a topic in your new and happy home.  But lets face it.  The percentages of marriages that end in divorce is extremely high--and this is between couples who share a common culture, language and often social background and status.

Marrying a foreign lady by its nature will involve a whole host of extraordinary stresses upon the marriage.  Most do surmount these difficulties, but many do not.  Simply put, a Prenuptial Agreement is insurance and protection of your assets and estate for yourself and for your heirs in the unfortunate event that you do get divorced.

I can help both you and your fiancee understand that having a fair and reasonable Prenuptial Agreement actually brings both of you peace of mind and safeguards against wasting your money and emotion quibbling over the marital estate in the event that the marriage does not work out.

Estate Planning

Finally, if you have not thought about Estate Planning before, it is absolutely crucial that you do so now that you are getting married.  You need to sit down and discuss with your bride serious questions concerning your medical and healthcare decisions, guardianships & custody arrangements, insurance, savings, trusts, gifts, asset allocation and the distribution of your assets and yes even funeral arrangements should either you or her die or become incapacitated.
